Website and Telephone Terms and Conditions of Sale

This legal notice applies to all purchases made by you:

(a) through the website under the domain name www.robertgraham1874.com (“the Site”) and

(b) through our telephone order line (“the Order Line”).

By offering to purchase products through the Site or the Order Line

you are entering into an agreement on the terms and conditions set out below with Robert Graham Ltd .

These terms and conditions are only available in English.

To visit our website, you must be of an age at which the purchase and consumption of alcohol and the purchase of tobacco products is permitted according to the legislation in your country of residence. 

 1. Products

Specifications of the products to be supplied by Robert Graham Ltd are not intended to be binding and are intended only to give a general description of the products.

All products are provided on an "as is" and "as available" basis. To the maximum extent permissible,

Robert Graham Ltd makes no other warranties or promises about the products, and any implied warranties are excluded.

2. Availability, Prices and Information

Robert Graham Ltd does not promise that products are necessarily available, and all products are offered for sale subject to availability.

The price for the products shall be the price listed on the Site or given on the Order Line on the date of your order exclusive of the delivery charges which will be added to the total amount due.

All prices displayed on the Site or given on the Order Line are quoted in UK Pounds Sterling (with an estimated value in USD and EUR - the exchange rate is approximate and changes daily). The payment will be processed in UK Pound Sterling only. The product price and the delivery charge must be paid in full except where discounts are offered as detailed on the Site or given on the Order Line.

Whilst all efforts are made to ensure accuracy of description, specifications and pricing there may be occasions where errors arise.

Should such a situation occur the company cannot accept your order.

The information displayed is considered as an invitation to treat not as a confirmed offer for sale.

The contract is confirmed upon supply of goods.

3. Age Verification

To visit our website, you must be of an age at which the purchase and consumption of alcohol and the purchase of tobacco products is permitted according to the legislation in your country of residence. 
It is our responsibility to ensure we do not sell age-restricted products online to people who are under that minimum legal age and as such for first time orders, or returning customers who did not sign up to be members of our site placing orders, we will take steps to verify the age of the purchaser.

In the UK, you must be 18 or older to buy alcohol. By placing an order with us online you are confirming you are 18 or older. It is an offence to sell alcohol to anyone under the age of 18 in the UK.  If you are buying alcohol for someone else the recipient also has to be 18 or older.

Deliveries must be accepted by a person aged 18 or older. If our couriers are in any doubt about the age of the recipient on delivery, they will request some form of ID. We reserve the right to cancel the delivery if the age and identity of the recipient is in doubt.

4. Ordering on the Site

You are responsible for ensuring the accuracy of your order.

If Robert Graham Ltd accepts your offer it shall confirm each order on-line via the internet

and/or by e-mail and Robert Graham Ltd confirmation of the order in writing (in the form of an email).

5. Ordering Through the Order Line

When you place an order through the Order Line you will be given an opportunity to review your orders, correct any errors and confirm your order. You are responsible for ensuring the accuracy of your orders.

6. Cancellation and Returns of Products

Robert Graham Ltd wants you to be totally satisfied with the products that it provides to you so our general rule is that if you would like to cancel your order for products and return them you may do so at any point within 7 working days from the day after receiving them (enclosing a copy of your product order confirmation/receipt and your reasons for returning the product).

No returns will be accepted for alcohol and cigars due to the nature of these products except when the wrong products have been delivered.

 If the product has been damaged, lost or stolen in transport and you purchased shipping insurance you should seek reimbursement from your insurance company.

If the product has been damaged, lost or stolen in transport but you have not purchased shipping insurance Robert Graham Ltd cannot be held responsible for this damage.

 Therefore Robert Graham Ltd strongly recommends purchasing a insurance policy for transport of your purchased goods.

If you are only returning part of an order, no refund will be given in respect of the delivery charges.

If you requested additional services such as gift wrapping, priority shipping or engraving,

no refund will be given for the additional charges incurred by you for these services.

The cancellation policy detailed above will not apply if the fault arises from fair wear and tear in our reasonable opinion, deliberate damage, accidental damage, negligence, abnormal working conditions, failure to follow manufacturer instructions, misuse or alteration or repair of the goods without manufacturer approval.

You will be responsible for meeting the costs of returning products to us unless the products are faulty or we have provided substitute products (the original products ordered having become unavailable).

None of this affects your rights to claim for defective or faulty goods or workmanship

under the Sale of Goods Act 1979 (as amended) or the Supply of Goods and Services Act 1982.

6.1. Exceptions.

No returns will be accepted for alcohol and cigars due to the nature of these products except when the wrong products have been delivered.

 If the product has been damaged, lost or stolen in transport and you purchased shipping insurance you should seek reimbursement from your insurance company.

 If the product has been damaged, lost or stolen in transport but you have not purchased shipping insurance Robert Graham Ltd cannot be held responsible for this damage.

 Therefore Robert Graham Ltd strongly recommends purchasing a insurance policy for transport of your purchased goods.

7. Limitation of Liability

Robert Graham Ltd  liability to you under the contract for the products is limited to refunding the price of the products  (including the delivery charges) as provided for in Clause 6, excluding the cases described in Clause 6.1.

Robert Graham Ltd is not responsible to you to any greater extent and in particular is not liable to you for any indirect or consequential loss (including without limitation financial loss such as loss of profit, or otherwise) that you may incur as a consequence of its failure to comply with these terms and conditions of sale.

8. Changes to the Terms and Conditions of Sale

Our terms and conditions of sale may be changed. Please review them regularly.

If you continue to use the Site or the Order Line after a change has been made you are deemed to have accepted it.

9. Overseas Customers

As Robert Graham Ltd is a United Kingdom company, all charges shown on the Site and given on the Order Line are in Pounds Sterling.

If you are placing an order from outside of the UK your card issuer may convert the charge into your local currency.

This Site, the Order Line and these terms and conditions have been designed for use within the UK.

Whilst Robert Graham Ltd will consider orders from outside the UK, Robert Graham Ltd give no warranty, express or implied, that the Site, the Order Line or the placing of any order through the Site or the Order Line from outside the UK complies with any applicable non-UK laws or regulations.

Accordingly, any sales or services not permitted under your local law are not offered to you.

Furthermore, Robert Graham Ltd reserves the right to refuse any order at its discretion from overseas customers and it will have no obligation to provide you with any reasons for refusing an order.

We are unable to ship tobacco products to the EU, USA & Canada.

All countries outside the E.U. may be subject to local customs charges and taxes, for which you will be liable.

10. Law and Jurisdiction

These terms and conditions of sale shall be governed by and construed in accordance with the laws of Scotland.

Any disputes arising in relation to the Site, the Order Line or these terms and conditions

shall be subject to the exclusive jurisdiction of the courts of Scotland.

If any of these terms or conditions of sale should be determined to be illegal, invalid or otherwise unenforceable, it shall be deemed deleted and the remaining terms and conditions shall survive and continue to be binding and enforceable.

12. Special Promotions

5% Off For New Customers Promotion
The 5% first order apply to the total value of an order (excluding the shipping costs) placed on the robertgraham1874.com website. The discount coupons  can only be redeemed once per customer.

The 5% off does not apply to the shipping costs.

The 5% code cannot be used on products that have a 'Special Online Price' sticker.

The 5% off code cannot be used on cigarettes, hand rolling tobacco and collectable, Limited Edition or rare products.

13. Additional Features

Gift Wrap will be supplied for a charge of £2.50 when this option is selected prior to order completion.

 For items that, in some cases, have to be sent direct from the supplier, the gift wrap charge will be refunded and your items sent to you in original packaging.
 

14. Privacy

We take steps to protect your privacy and comply with all applicable UK data protection legislation in place at the time of your use of This Site in respect of any personal information relating to you gathered by us.

The data we collect from you is used solely for the purpose of fulfilling your order or sending you the newsletter. 

You may be asked to input information about yourself on different pages of This Site. We will never disclose your personal information to any other parties without your consent except as set out in our Privacy Policy or to verify your identification as above.

Your credit card information is not retained and is completely removed from our system after your order is processed or cancelled.

You have every right to know what information has been held in our system.

THESE TERMS AND PRIVACY POLICY
By entering this competition, entrants confirm they have read, understand and agree that these terms and our Privacy Policy (and the way we process personal data) are binding to them.  We reserve the right to amend these terms; to hold void, suspend, cancel or amend this competition at any time.

ELIGIBILITY:
This competition is only open to individuals who are 18 years or older and residents of the UK. Ineligible entries will be discarded. The competition is not open to any employees (and their immediate family) of the promoter or any of its associated companies. We reserve the right to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) at any time and reserves the right, in its sole discretion, to disqualify any individual who, or any entry which, it believes has breached any of these terms, tampered with the entry process or engaged in any unlawful or improper conduct which may undermine the fair and proper conduct of this competition.

ENTRY/COMPETITION PERIOD:
This competition opens at 09:00:00 BST on 08 June 2021 and closes at 23:59:59 BST on 30 June 2021.

HOW TO ENTER:
To enter, individuals must within the entry period purchase any 70cl qualifying bottle from the Tomatin range (original bottlings by and from Tomatin only, excluding independent bottlings and Cù Bòcan range) as available and listed on the Robert Graham website (each being a qualifying purchase or qualifying entry). Multiple entries are permitted.

ONLINE ENTRIES / OPT OUT OF COMPETITION
Online purchases will be automatically entered into the competition. To opt out of the competition please email [email protected] with your order number and request not to be entered into the competition
WINNER(S): There will be 1 prize for 1 winner, who will be selected at random out of all qualifying entries shortly after the competition period. The selection of the winner made will be final and no correspondence or discussion will be entered into.

THE PRIZE: The winner will win a prize consisting of:
1 x 70cl bottle of Tomatin 12 year old 125th Anniversary Packaging
1 x Private virtual tasting from Tomatin Distillery Blender & Global Ambassador Scott Adamson (including 6 x (3x5cl) miniature packs for the Private Virtual Tasting) packs

SHIPPING RESTRICTIONS:
This competition is only open to UK residents, and as such the prize can only be delivered to UK addresses

CLAIMING THE PRIZE:
Robert Graham will make reasonable efforts to contact the winner via email or by telephone as soon as practicable after the entry period has closed. If any winner cannot be contacted or is not available or has not claimed the prize within 5 days of Robert Graham contacting them, Robert Graham reserves the right to offer the prize to another eligible entrant. Robert Graham cannot accept any responsibility if any winner is unable to take up the prize or fails to claim the prize within the time limit as set out above.
Robert Graham may contact the winner for feedback in respect of the competition and/or prize and may use any feedback provided when announcing the results and promoting the Competition or subsequent competitions.

LIMITATION OF LIABILITY:
Insofar as is permitted by law, the promoter, its agents, employees, and/or representatives shall in no circumstances be responsible or liable to compensate any entrant who participates in the competition and/or the winner and their guest(s) who claim(s) the prize for any loss, damage, personal injury or death whatsoever and howsoever caused, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any direct, indirect or consequential losses arising out of or in connection with their participation in this competition, except where it is caused by the negligence of the promoter, its agents, employees, and/or authorised representatives. Competition entrants’ statutory rights are not affected.
